The professions of law and legal consultancy are professions that require a high commitment to ethical and professional standards. To ensure that these two professions operate in accordance with legal and ethical controls, the Professional Conduct Committee for Lawyers and Legal Consultants in the Emirate of Dubai was formed pursuant to Administrative Resolution No. (112) of 2017 regarding the Professional Conduct Committee for Lawyers and Legal Consultants and its amendments, and was reconstituted pursuant to Administrative Resolution No. (54) of 2022 regarding the Disciplinary Accountability System for Lawyers and Legal Consultants in the Emirate of Dubai. The Lawyers and Legal Consultants Violations Committee was also formed in the Emirate of Dubai pursuant to Administrative Resolution No. (55) of 2022. These two committees play an important role as they aim to provide a fair and transparent mechanism for dealing with professional and behavioral violations issued by violating lawyers and legal consultants. This course focuses on the ethics of the legal profession and legal advice, the rules of professional conduct that must be adhered to by lawyers and legal advisors, and the consequences of violating them, including disciplinary accountability and professional and behavioral responsibility.

This course looks at the law of tort under common law, focusing on English law (as applied in the ADGM) and the DIFC. It focuses on the principles of claiming for economic loss and the torts more frequently associated with business activities, such as negligent misstatement, misrepresentation and the economic torts (for example inducing a breach of contract and breach of confidence). These principles will be discussed in contrast to the provisions relating to acts causing harm under the Civil Code, and other relevant UAE law provisions.

This is an excellent refresher session for common law trained lawyers, as well as providing a good background understanding of this body of law for civil law trained lawyers.

This course provides a comprehensive examination of UAE nationality and immigration law according to Nationality Law No. 17 of 1972, as amended by Law No. 10 of 1975 and Federal Decree-Law No. 16 of 2017 and according to the Executive Regulations, as amended in 2021.

• Acquisition of Emirati Nationality:
 By operation of law: Birthright citizenship and attribution of nationality;
 By marriage: Spousal naturalization requirements and procedures;
 By naturalization: Eligibility criteria, application process.

• Loss of Emirati nationality: Voluntary through renunciation or unvoluntary through deprivation.

• Recovery of the UAE nationality: Legal pathways to regain citizenship.

As online commerce continues its rapid expansion in the country, understanding the legal framework surrounding consumer protection in electronic transactions is crucial for both businesses and legal professionals.
This course is designed at the intersection of consumer protection law and digital commerce, equipping participants with the tools and knowledge needed to ensure compliance with the latest regulations. It offers a thorough understanding of consumer rights and the business obligations in the ever-evolving digital landscape.
Participants will explore the recently enacted legislations which aim at safeguarding consumer rights in general, with a particular focus on electronic transactions.
These include:

– The Federal Law No. 15 of 2020 on Consumer Protection, as amended by Law No. 5 of 2023, in addition to Cabinet Resolution No. 66 of 2023, which issued the executive regulations for the Consumer Protection Law effective from October 2023.

– Federal Decree-Law No. 14 of 2023 on Commerce through Modern Technology (E-Commerce Law) which came into effect in September 2023, governing consumer rights in e-commerce transactions.

The principles of personal honour, reputation, and ’standing’ in the community have been a cornerstone of social structures across the world, both current and historical. Equally, notions of freedom of expression, freedom of speech, and the right to comment are concepts that can come into conflict with these principles. In an increasingly digital world, and where the ability to immediately reach a national, regional or international audience can potentially cause unintended or intended harm to the reputation of others, an understanding of defamation is critical to our professional and personal interactions with others.

The aim of this course is to:

• Provide an awareness of the principles of defamation
• Apply knowledge and understanding of defamation law in professional practice
• Undertake a comparative analysis of corresponding principles in the UAE with other jurisdictions (USA and UK).

Before enactment of the first Bankruptcy Law in 2016, traders and distressed companies had to settle financial disputes amicably (which was very difficult) or through legal procedures that were destructive to the business or the value of its assets. The new Bankruptcy Law has substantially changed the context and marked a paradigm shift. The new law provides mechanisms for traders and companies to seek and take appropriate solutions for the financial crises which they face, with key procedures including preventive settlement, restructuring, and insolvency.

The UAE Bankruptcy Law, Practice and Trends – a Masterclass will provide an overview of developments of the UAE bankruptcy regime and the most recent changes to the regulatory framework as well as the, sometimes complex, considerations arising in bankruptcy proceedings in the UAE. The course will explore the range of options available in disputes from the perspective of both creditors and debtors and will set out the most recent judicial trends and landmark judgements in the light of an increasing body of precedents in the Courts of the UAE. It will be practical in nature, featuring a particular focus on the procedural and substantive considerations that arise under Bankruptcy Law, assess the risks which legal counsel must be aware of, and highlight areas where there remains ambiguity as to the extent that the previous Bankruptcy Laws remain applicable.

The course will also feature a podcast covering theoretical aspects of the Bankruptcy Law and expectations regarding developments for the coming years.

The course will provide a review of relevant substantive civil and criminal laws, focusing on key principles and regulations. Participants will also examine the procedural aspects of civil and criminal procedure laws.
The course will include case studies of both criminal and civil proceedings, incorporating typical documentation from the Court of First Instance, Court of Appeal, and Cassation Court. Additionally, the civil proceedings case study will include documentation from the Execution Court.
To conclude, participants will complete a quiz and review the course objectives to reinforce their understanding of the material.

The course will provide a review of typical insurance policy terms, including schedules, insuring clauses, exclusion clauses, law and jurisdiction clauses, endorsements, and general conditions. Participants will gain an understanding of the role of Sanadak and the dispute committee, as well as common areas of conflict between insured parties and insurers.

The course will also include two case studies of insurance coverage disputes to provide practical insights. Finally, participants will complete a quiz and review the course objectives to consolidate their understanding of the material.
